1. Introduction

Welcome to ProptInspector, operated by Resilient Forge Private Limited ("Company", "we", "our", "us"). These Terms & Conditions ("Terms") govern your use of the ProptInspector mobile app, website, and related services ("Services").

By accessing or using the App, you agree to:

  • These Terms & Conditions
  • Our Privacy Policy
  • Our Refund Policy

If you do not agree with any part of these Terms, you must stop using the App immediately.

2. Scope of Services

ProptInspector provides remote property inspection services. Users can book inspections for:

  • Land
  • Homes
  • Apartments
  • Commercial properties
  • Other real estate assets

Our agents visit the property, capture photos, videos, GPS-check-ins, and observations, and prepare a report.

Important Limitations

ProptInspector does NOT provide:

  • Legal verification or document validation
  • Structural engineering assessment
  • Property valuation
  • Boundary surveys or encroachment audits
  • Dispute resolution with tenants or neighbours

All inspection reports are observational only and based on agent access.

3. Eligibility

To use our Services, you must:

  • Be 18 years or older or using under the supervision of a legal guardian
  • Be legally competent to enter contracts
  • Provide truthful and verifiable information
  • Ensure compliance with your local laws if using the App outside India

We reserve the right to restrict services in certain regions.

4. User Account & Security

You may register using your email and password or mobile number and OTP.

You are responsible for:

  • Maintaining the security of your login details
  • Preventing unauthorized access to your account
  • Updating your information when required

We are not liable for loss caused by shared credentials, weak passwords, or negligent account management.

5. User Responsibilities

As a user of ProptInspector, you agree to the following responsibilities:

5.1 Provide Accurate and Legally Valid Information

You agree to provide accurate, complete, and legally valid personal details, property details, and supporting documents. This includes, but is not limited to:

  • Property ownership documents
  • Survey numbers, document numbers, and location details
  • Identity proof (if requested)
  • Authorization letters (if you are booking on behalf of the owner)
  • Any other verification documents required by the Company

You confirm that:

  • You own the property (OR)
  • You are legally authorized by the owner to request an inspection

You also confirm that all documents uploaded are genuine, unaltered, and obtained lawfully.

The Company may request additional documents at any time to verify your identity, authority, or property ownership.

5.2 Responsible Use of the Platform

You must:

  • Provide correct information for the inspection
  • Ensure property access when required
  • Not upload inappropriate, harmful, or copyrighted content
  • Not misrepresent your identity or ownership
  • Not threaten, abuse, or harass field agents or support staff

5.3 Prohibited Activities

You must not:

  • Engage in fraud or impersonation
  • Attempt to hack, damage, or reverse-engineer the App
  • Use the App for illegal activities
  • Provide misleading or incomplete property details

6. Inspection Process & Limitations

After booking, an agent will visit the location and record observations. Inspections are limited to visible and accessible areas only.

Agents will not:

  • Break locks, gates, or enter forcibly
  • Enter private premises without permission
  • Engage in disputes or confrontations
  • Climb unsafe structures
  • Verify legal property documents
  • Perform intrusive checks or surveys

The accuracy of the report depends on:

  • User-provided details
  • Local accessibility
  • Environmental and lighting conditions

The Company is not responsible for undetected issues, hidden defects, tenant disputes, boundary errors, or any legal conclusions.

7. Payments, Charges & Saved Payment Information

All payments must be made through our secure in-app payment gateway. Prices may vary by location and inspection type.

Payment Information Storage

  • By default, we do not store full card or bank details.
  • If you provide explicit consent, encrypted or tokenized payment data may be stored by our payment provider for:
  • Subscription renewals
  • Faster future payments
  • Auto-pay features

Stored payment data follows industry-standard security practices.

Auto-Renewals

  • Subscriptions will auto-renew solely upon your explicit recurring-payment consent; in all other cases, manual renewal is required.
  • Renewal charges that are already processed are not eligible for refund unless defined under the Refund Policy.

8. Cancellation, Rescheduling & Refunds

All refunds, cancellations, and rescheduling are governed by our Refund Policy.

Key points:

  • Cancellations are not allowed once the agent is assigned or dispatched.
  • Subscription renewals already processed cannot be refunded.
  • Rescheduling is subject to agent availability and operational feasibility.
  • Delays due to weather, safety issues, or external restrictions will lead to rescheduling, not refunds.

9. Data Privacy & User Information

By using the App, you agree to our Privacy Policy. We collect user data such as:

  • Personal information (name, email, phone)
  • Property details
  • Photos & videos
  • Location data (if permitted)
  • Device and usage data
  • Transaction details (excluding full card/bank numbers)

Data Handling Standards

We follow:

  • Applicable data protection regulations
  • Applicable privacy requirements
  • Industry-standard data security practices

Your data may be stored on secure servers inside or outside your country.

Users have the right to:

  • Request data deletion
  • Request data correction
  • Close their account
  • Request access to their data

10. Intellectual Property

All content in the App, including:

  • Logos
  • Reports
  • Media
  • UI/UX elements
  • Templates
  • Software
  • Branding

belongs exclusively to Resilient Forge Private Limited.

Users may not reproduce, sell, or reuse any content without written consent.

11. Third-Party Services

ProptInspector may integrate with:

  • Payment gateways
  • Map services
  • Authentication providers
  • Cloud storage services

We are not liable for failures or breaches that arise from third-party systems.

12. Indemnification

You agree to indemnify and hold Resilient Forge Private Limited, its employees, directors, and agents harmless from any claims, losses, liabilities, damages, or expenses arising from:

  • Your misuse of the App
  • False or incomplete information you provide
  • Legal disputes involving your property
  • Violation of these Terms
  • Unauthorized access to your account
  • Any illegal or harmful activity done through your account

This obligation continues even after your account is terminated.

13. Limitation of Liability

To the fullest extent permitted by law, the Company is not liable for:

  • Indirect or consequential damages
  • Loss of profits or business
  • Hidden defects not visible during inspection
  • Errors due to limited accessibility
  • Disputes with neighbours, tenants, or third parties
  • Legal issues related to ownership, encroachment, or property rights

Our maximum liability is limited to the amount paid for the specific inspection service.

14. Termination of Account

We may suspend or permanently terminate your account if we detect:

  • Fraudulent activity
  • Illegal behavior
  • Misuse of reports or app content
  • Threats or harassment toward agents or staff
  • Repeated violations of these Terms
  • Chargebacks or payment fraud

If terminated:

  • You may lose access to past reports
  • Refunds will not be provided unless required by law

Users may voluntarily delete their account anytime.

15. Governing Law & Dispute Resolution

For users in India, these Terms are governed by Indian law, and disputes will be resolved under the exclusive jurisdiction of the courts of Visakhapatnam, Andhra Pradesh.

For international users:

  • Primary governing law remains India
  • Local regulations may apply for consumer rights
  • Cross-border disputes will be handled through negotiation or arbitration wherever possible

16. Changes to Terms & User Acceptance

We may update or modify these Terms at any time.

You will be notified of updates through:

  • App notifications (or)
  • Website announcement

For significant changes, you may be required to re-accept the Terms before continuing to use the App.

Continued use of the App after updates means you accept the revised Terms. If you do not agree, you must stop using the App and request account deletion.
